Fuuti Technological Innovation Inc.

1. Parties and Agreement
This Agreement is made between:

• USER: The individual(s) utilizing the Fuuti device.
  Fuuti Technological Innovation Inc.: The supplier of the Fuuti device.

By using the Fuuti device, the USER agrees to the following terms and conditions.

2. Emergency Alert System
The Fuuti is designed as a first-response alert system to notify designated family members, friends, caregivers, or neighbors in emergency situations. While 911 can be added as a contact, the device does not guarantee emergency response, assistance, or protection within a specific timeframe.

3. Limitations of Mobile Network Coverage
The effectiveness of the device is subject to mobile network availability (4GX, 4G, or 3G). While Fuuti Technological Innovation uses predictive coverage maps, these maps do not guarantee service in all areas. Users must be aware that signal limitations may arise due to:

• Physical structures such as basements, tunnels, underground parking lots, and concrete buildings.
  Natural obstructions such as hills, mountains, and dense foliage.
  Network disruptions or outages.

Users are responsible for testing the device regularly to ensure connectivity and functionality.

4. Limitations of GPS Functionality
The GPS tracking feature of the device is subject to industry-standard limitations. If the pendant cannot acquire a GPS signal, it will either provide its last known location or may not transmit a location at all. Users should note:

• GPS signals can be obstructed by buildings, tunnels, underground areas, and similar environments.
  The device does not use triangulation methods to determine location.
  The GPS location update frequency depends on movement and power-saving settings.

5. Fair Use Policy and Emergency Communications
The Fuuti Device is intended strictly for emergency use and is not a substitute for a standard mobile phone. Users acknowledge:
The device’s SIM card operates under Fuuti’s Fair Use Policy.
An annual subscription fee applies for text alerts, GPS tracking, and voice call functions.
Emergency text and voice call rates are subject to change.
Fuuti Technological Innovation does not guarantee uninterrupted emergency communication and shall not be held liable for service failures beyond its control.

6. Limitation of Liability
Fuuti Technological Innovation Inc. disclaims any liability for:
Any injury, harm, or death resulting from the use or failure of the device.
Delays, failures, or errors in emergency response times.
Loss, damage, or personal injury caused by individuals responding, failing to respond, or responding inadequately.
Damage due to misuse, improper installation, lack of maintenance, or failure to adhere to operational instructions.

7. Returns and Refund Policy
Fuuti Technological Innovation Inc.’s return and refund policy is available on its website. Users acknowledge that they had access to this policy at the time of purchase.

8. Delivery and Acknowledgment of Terms
By purchasing and using the Fuuti device, the USER acknowledges that these terms and conditions:
Were made available online via the Fuuti website.
Were included in the product packaging and delivered via Canada Post.

9. Conflict Resolution
In the event of a conflict between this Agreement and any purchase order or related document, this Agreement shall take precedence, regardless of whether such documents were issued before or after this Agreement.

10. Entire Agreement & Severability
This Agreement constitutes the full understanding between the parties. No modifications or amendments shall be valid unless agreed to in writing by both parties. If any provision of this Agreement is deemed invalid, the remaining provisions shall continue in full force and effect.

11. Jurisdiction and Legal Proceedings
This Agreement is governed by the laws of Canada. Any legal disputes shall be resolved within Canadian jurisdiction. Notices and legal communications shall be delivered via Xpresspost by Canada Post to the parties’ addresses as specified in this Agreement or any subsequently provided address.
The parties acknowledge that disputes may be resolved through mediation or arbitration as an alternative to litigation.

Acknowledgment and Agreement
By using the Fuuti device, the USER confirms that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
